「ビュリダンのロバ」という例え話があるようです。道中で、その先に食糧がある２つの道の分岐点に立ったロバが、そのどちらの道を選ぶかに迷ってしまい、結局その場で餓死してしまうという寓話です。物悲しいながらもどこか滑稽なお話です。
（冷静に考えると、時間をかけてでも両方の道を進んでみるという選択肢もあったのではないかとも思いますが。。）
いくつかの選択肢があり、悩んだ挙句そのどれかを選んだとしても、後々になって「もしかしたら、もう一方の方が良かったのではないか…」という考えが沸き上がってくる可能性はどうしても残ってしまうのですね。
オリンピックの金メダリストのように一つの道を極めた人であっても「これ以外にも色々な生き方があったんだよな…そっちの生き方もしてみたかった。」と考え、絶望的に後悔することがあるそうです。
定食屋でサバの味噌煮定食を食べた後に「麻婆豆腐定食にするという方法もあったんだな。」と思う場合や、居酒屋でビールを頼んだ後に「そろそろウイスキーにするという手もあったんだな。」と思う場合であっても同様です。このような例を挙げれば枚挙に暇がないですが、徐々にレベルが下がっている気がするのでこの辺にしておきます。
法律問題においても、同様のことが起こり得ます。
ある法律問題が生じた場合に採りうる手段には、実に様々なものがあります。弁護士の立場としては、考えられる全ての手段についてご説明させていただきます。しかし、依頼者様が、色々な手段の中からどれを選ぶのが良いのか悩んでしまう可能性もあります。
このような場合、弁護士として、どのように依頼者様の利益を考えるのかというのは難しい問題です。
できれば、依頼者様には「ビュリダンのロバ」のようになって欲しくありません。しかし、弁護士が一方的に方針を決め、依頼者様の選択の機会を奪ってしまうこともまた避けなければならないことです。
弁護士としては、ただ色々な手段を示すだけで依頼者様を悩ませてしまうのではなく、依頼者様にとって本当に良い方法は何なのかを、共に考えていければと考えております。
